Terms of Service

1. Acceptance of Terms

By accessing or using Spiceful—whether through our website at getspiceful.com, our iOS or Android mobile application, or any related services (collectively, the “Service”)—you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. Pretty standard stuff.

2. Eligibility

You must meet the following requirements to use Spiceful:

• You must be at least 13 years of age (or the minimum age required in your jurisdiction)
• If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian
• You must be able to form a binding contract with us under applicable law
• Your use of the Service must not violate any applicable laws or regulations

3. Description of Service

Spiceful is a recipe management, grocery list, and meal planning application available on the web and as a mobile app for iOS and Android. We provide tools to help you organize your recipes, plan meals, create shopping lists, and import recipes from the web using AI-powered extraction. Think of it as your digital kitchen assistant.

4. User Accounts

To use Spiceful, you must create an account using one of our supported authentication methods (email and password, Google sign-in, Apple sign-in, or magic link). You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality and security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

5. Subscriptions and Billing

Spiceful offers a free tier and a paid Premium subscription. The Premium tier unlocks additional features and higher usage limits.

Pricing

• Free tier — $0 with limited features (up to 10 recipes, 10 AI imports per month, 25 MB image storage, 1 grocery list, 7-day meal planning horizon)
• Premium tier — $4.99/month or $49.99/year with expanded limits and advanced features including unlimited recipes, 200 AI imports per month, 1 GB image storage, multiple grocery lists, smart grocery consolidation, and 90-day meal planning

Billing

On the web, subscriptions are processed by Stripe, our third-party payment processor. On our iOS and Android mobile apps, subscriptions are processed through the Apple App Store or Google Play Store, respectively. By subscribing, you authorize recurring charges at the then-current rate for your chosen billing interval.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the applicable subscription fee for the next billing cycle unless you cancel in advance.

Cancellation

You may cancel your subscription at any time. For web subscriptions, you can cancel through your account settings or the Stripe billing portal. For mobile subscriptions, you must cancel through the Apple App Store or Google Play Store settings on your device. After cancellation, you will retain access to Premium features until the end of your current billing period, at which point your account will revert to the free tier.

Refunds

Web subscription payments processed through Stripe are generally non-refundable, except where required by applicable law. For mobile subscriptions purchased through the Apple App Store or Google Play Store, refunds are subject to the respective store's refund policies. We recommend reviewing Apple's or Google's refund policies for details.

Price Changes

We may change subscription pricing from time to time. Any price changes will take effect at the start of your next billing cycle after notice has been provided. Your continued use of the Premium tier after a price change constitutes acceptance of the new price.

6. Mobile Application

The Spiceful mobile app is available for iOS and Android through the Apple App Store and Google Play Store. By downloading or using the mobile app, you also agree to the following:

• You acknowledge that these Terms are between you and Spiceful, not with Apple Inc. or Google LLC
• Apple and Google have no obligation to provide maintenance, support, or warranty for the app
• In the event of any failure of the app to conform to applicable warranties, you may notify Apple or Google for a refund of the purchase price (if any); beyond that, Apple and Google have no other warranty obligation
• Apple and Google are not responsible for addressing any claims related to the app, including product liability, legal compliance, or intellectual property claims
• Apple and Google are third-party beneficiaries of these Terms with respect to the mobile app and may enforce them
• You must comply with the applicable App Store or Google Play terms of service when using the app

7. AI-Powered Features and Third-Party Services

Spiceful uses artificial intelligence to power certain features, including recipe import from URLs, recipe extraction from photos, and recipe translation. When you use these features:

• Content you submit (such as webpage text, images, or recipe text) is sent to OpenAI for processing. This data is transmitted securely and used solely to provide the extraction or translation service
• AI-generated results may not be perfectly accurate. You should review imported recipes for correctness before relying on them—especially quantities and cooking times
• AI import usage is subject to your subscription tier limits (10/month for free, 200/month for Premium)

In addition to OpenAI, Spiceful relies on the following third-party services to operate:

• Supabase — Database hosting, authentication, and file storage
• Stripe — Payment processing for web subscriptions
• RevenueCat — In-app purchase and subscription management for mobile
• Google & Apple — OAuth authentication and app distribution
• Rollbar — Error monitoring and crash reporting to improve service reliability

Your use of the Service is also subject to the terms and privacy policies of these third-party providers.

8. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload malicious content, code, or malware
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the Service's operation or infrastructure
• Scrape, crawl, or harvest data from the Service
• Circumvent or attempt to circumvent any usage limits, subscription restrictions, or security measures
• Use automated tools (bots, scripts, etc.) to access the Service without our written permission
• Upload content that is obscene, defamatory, or infringes on the rights of others
• Resell, sublicense, or commercially exploit any part of the Service

We reserve the right to suspend or terminate your account if we reasonably determine that you have violated these terms.

9. Your Content

You retain full ownership of any recipes, images, grocery lists, meal plans, or other content you create or upload to Spiceful (“Your Content”). By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, display, and transmit Your Content solely as necessary to provide and improve the Service. Your grandma's secret cookie recipe is still yours.

You are solely responsible for the content you upload and must ensure you have the necessary rights to that content. We do not monitor or pre-screen user content, but we reserve the right to remove content that violates these Terms.

10. Recipe Import

When importing recipes from external websites or photos, you are responsible for ensuring you have the right to use that content. Spiceful's AI-powered import feature extracts and normalizes recipe data for your personal use. We do not claim ownership of imported recipes—we just help you organize them.

Imported recipes are for your personal, non-commercial use only. You agree not to use the import feature to systematically copy or redistribute content from third-party websites.

11. Image Uploads and Storage

You may upload images to Spiceful for your recipes. Image storage is subject to your subscription tier limits (25 MB for free, 1 GB for Premium). By uploading images, you agree that:

• You own or have the right to use any images you upload
• Images must not contain illegal, obscene, or harmful content
• Images are stored privately and accessible only to you via time-limited signed URLs
• We may impose file size limits (currently 10 MB per recipe image and 20 MB for AI image imports)

12. Push Notifications

The Spiceful mobile app may send push notifications for features such as meal plan reminders and grocery list updates. You can manage or disable push notifications at any time through your device settings. Enabling notifications is optional and not required to use the Service.

13. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Spiceful and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use them without our prior written permission.

14. Account Termination

We may suspend or terminate your access to the Service at any time if:

• You violate these Terms
• Your account is used for fraudulent or illegal activity
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

You may delete your account at any time through your account settings. Upon account deletion, we will cancel any active subscriptions, remove your stored files, and permanently delete your data from our systems. This action is irreversible.

15. Service Availability and Modifications

We strive to keep Spiceful available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.

16. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, secure, or error-free, that results obtained from the Service will be accurate or reliable, or that any defects will be corrected. AI-powered features may produce inaccurate results. We also can't be held responsible if your soufflé doesn't rise.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Spiceful and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to or alteration of your data; (c) any third-party conduct on the Service; (d) AI-generated content that is inaccurate or incomplete; or (e) any other matter related to the Service. Our total liability for all claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

18. Indemnification

You agree to indemnify, defend, and hold harmless Spiceful and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your content, or your violation of any rights of a third party.

19. Privacy

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

21. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last updated” date. For significant changes, we may also notify you via email or an in-app notification. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

22. General Provisions

• Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spiceful regarding your use of the Service and supersede any prior agreements.
• Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.
• No Third-Party Beneficiaries. Except as expressly stated in Section 6 (Mobile Application) regarding Apple and Google, these Terms do not create any third-party beneficiary rights.
